California Dept. of Fish & Wildlife legal confession: we have no scientific evidence that “chronic wasting disease” spreads from “infected” to healthy animals

Not even 1 study authored by anyone, anywhere, ever

An attorney for California’s Department of Fish and Wildlife (CDFW) has officially confessed that the department has no scientific evidence to support its claim that “chronic wasting disease” spreads from “infected” animals to healthy animals.

On September 21, 2025, Jeffrey Burt submitted the following records request (pg 3) to the department, per the California Public Records Act:

““Chronic wasting disease” (CWD) is said to spread to healthy animals by contact with infected animals. I request a scientific study that has demonstrated contagion or transmission of CWD. The study (any study) requested should obviously adhere to the scientific method, using natural exposure methods, and using valid controls. To summarize the request, please provide a study that demonstrates that CWD is contagious.”

The request was assigned reference number R017303-092125. Later, on October 21, 2025, William Schmelter acting as “Attorney, Office of General Counsel” provided the department’s response, confessing to Jeffrey (see pg 2):

“CDFW has conducted a thorough and diligent search of its records and determined that it does not possess records responsive to your request.”

Schmelter went on to provide a quote from CDFW claiming that while the department had not conducted any research on the topic, it relies on a “significant body of scientific evidence”.

However, the department failed to provide or cite even one study adhering to the scientific method, authored by anyone, anywhere, and had already admitted to having none. Instead, the department source cited a review, the website of the National Academies of Sciences and a general overview from the CDC (bolding is mine):

CDFW has not done any research on the transmission of CWD, instead we rely on the significant body of scientific evidence and literature on CWD and other prion disease produced by numerous researchers since at least the 1960s. A review of “State of Knowledge Regarding Transmission, Spread, and Management of Chronic Wasting Disease in U.S. Captive and Free-ranging Cervids Populations” was recently completed by The National Academies of Sciences. From their website “In 2020, Congress passed America’s Conservation Enhancement (ACE) Act (P.L. 116-188), directing the U.S. Fish and Wildlife Service to lead a task force for addressing CWD in the United States drawing on a study commissioned from the National Academies. This report will assist the task force in prioritizing research and developing future CWD management strategies. It describes the state of knowledge regarding how CWD is transmitted among cervids, the current distribution of disease outbreaks, and the effectiveness of current diagnostic, prevention, and control methods available to limit the spread of the disease.” This report is the most recent and comprehensive review of the transmission, spread and management of CWD in the U.S. and an excellent resource to provide this requestor. Numerous other published reports and reviews are available online as well. Finally, the U.S. Centers for Disease Control and Prevention – https://www.cdc.gov/chronic-wasting/animals/index.html – provides a general overview of CWD.

Schmelter signed off by telling Jeffrey that if he had any questions or wished to discuss the matter further he should respond to Schmelter’s message (pg 2).

Jeffrey reviewed the cited sources and responded to Schmelter the very next day (pg 1):

“I request the scientific evidence that CDFW is relying on to make the claim, “CWD spreads to cervids through contact with infected animals…” which is a statement on the CDFW website.

I am hopeful that there does exist a reference to a scientific study (not a reference to a statement from CDC, not a reference to a CWD surveillance program, neither of which are scientific studies) supporting that assertion that CWD spreads through contact. In the CDFW response you provided, it is stated that they rely on “scientific evidence” (that CWD is contagious or transmissible), which is precisely what I am requesting.

I have reviewed the links that were offered and unfortunately cannot find a scientific study within those links. Could you please help me in my search for the scientific evidence that CDFW relies on to assert that CWD is contagious?”


Schmelter failed to respond.

Below is the result of a subsequent email exchange between Jeffrey and CDFW’s “Chronic Wasting Disease Team” (pg 5). Jeffrey reiterated that he sought any study that scientifically demonstrated contagion of “chronic wasting disease”. None was ever provided.

And below is an auto-transcription of a phone message (pg 6) that Jeffrey received from CDFW’s “top epidemiologist” who also failed to cite even one scientific study and oxymoronically confessed reliance on “scientific consensus”.

Once again, institutional “experts” feigning scientific knowledge failed spectacularly when challenged to support their impressive-sounding claims with actual evidence.
